Our divorce advice can help resolve the problems arising from your marriage. We attempt to make the divorce procedure as simple, swift and amicable as possible whilst getting the best result for you and your family.
In order to obtain a divorce, you must have been married for at least 12 months. The only ground for a divorce is on the basis of irreconcilable breakdown of marriage. This can be based on either:
Desertion for more than 2 years
Two years separation with the other party's consent
Five years separation
A divorce that has no other issues (including financial or children disputes) will usually take between 5 and 6 months to be finalised. A divorce is obtained in two parts, Decree Nisi being the first part of your divorce and Decree Absolute brings your marriage to an end. In most cases there will be no need for you to go to court.
Dissolution of civil partnerships
If your relationship breaks down, an application for the dissolution of your partnership may not be made within the first year of your civil partnership. The partnership must have irretrievably broken down by reason of one of the following legal grounds. These are:
Your partner's unreasonable behaviour
Your partner's desertion after two years
Two years separation with your partner's consent to the dissolution
Five years separation
Adultery is not a separate ground and if there is an allegation of infidelity, it should be included under unreasonable behaviour.
The process of dissolution takes about five to six months but can be longer if there are issues with finances or children.

It is possible to protect your financial position before entering into a marriage or civil partnership by entering into a prenuptial or pre-registration agreement.
